The terms that govern your use of Mana Grove, including your account, the decks and collection data you create, and the plans you can subscribe to.

The Mana Grove Trading Cards Ltd.
Version 2.3
What changed in version 2.3. Section 7.2 keeps the rule that there is no free trial and now names its only exception: a free trial or free month that comes with a creator, store or event code we issue. Sections 7.4 and 7.5 now cover offers as well as promotional codes. Section 9.6, about Scry on Discord, and its entry in the Section 1.3 list of defined terms are new. Sections 11.1 to 11.6 are unchanged.
Accounts created before September 13, 2026 remain on version 1.3 until they accept version 2.0 or later.
These Terms of Service (the "Terms") govern your access to and use of Mana Grove. They are a contract between you and The Mana Grove Trading Cards Ltd. ("Mana Grove", "we", "us", or "our"), a corporation incorporated under the federal laws of Canada. You can reach us at support@themanagrove.com.
1.1 By creating an account or otherwise using Mana Grove, you agree to these Terms. Our Privacy Policy and Cookie Policy are separate documents referenced in these Terms (Section 14). If you do not agree, do not use Mana Grove.
1.2 If you use Mana Grove in the course of a business, you remain personally bound by these Terms. Mana Grove accounts are personal accounts; we do not currently offer organizational accounts.
1.3 A few terms are bolded the first time they appear because they have a specific meaning in these Terms: the "Platform" (Section 2), "Grover" (Section 2.2), "Subscription" (Section 7), and "Scry on Discord" (Section 9.6).
2.1 What "Platform" means. The Platform is our website and, when available, our mobile applications, together with the features, tools, and services we offer through them.
2.2 What Mana Grove does today. Mana Grove is a set of tools for players of trading card games. At launch, the Platform includes:
2.3 What is not currently available. The following are not part of the Platform today, are not included in any Subscription tier, and nothing in these Terms grants you access to them: a card scanner, a peer-to-peer marketplace, social badges, direct messaging between players, and a public developer API. See Section 6.3 for how we handle features we add in the future.
2.4 Where Mana Grove is available. Mana Grove is available in Canada, the European Union, the United Kingdom, and the United States; the countries where a paid Subscription can be purchased are listed at checkout. We may restrict or limit access from a region where the Platform is not yet offered, including by technical means. Attempting to circumvent a regional restriction is a breach of Section 5.
3.1 You must meet the minimum age below to create a Mana Grove account, based on where you live:
| Where you live | Minimum age |
|---|---|
| Canada | 16 |
| United Kingdom | 18 |
| European Union / European Economic Area | 18 |
| United States | 18 |
| Everywhere else | 16, or the minimum age to independently consent to an online service under the law that applies to you, whichever is higher |
3.2 By creating an account, you confirm that you meet the minimum age that applies to you. We do not currently operate a parental-consent program, so if you cannot meet this requirement on your own, you may not use Mana Grove.
3.3 If we learn that an account belongs to someone who did not meet the applicable minimum age when they created it, we may suspend or terminate the account and delete or restrict the associated personal information, consistent with the Privacy Policy.
4.1 Registration. You must provide accurate information when you create your account and keep it up to date. Accounts are for individual use: one person, one account.
4.2 Security. You are responsible for keeping your account credentials confidential and for all activity that happens under your account. Do not share, sell, or transfer your account to anyone else. If you suspect someone else is using your account, or that your credentials have been compromised, tell us promptly at support@themanagrove.com.
4.3 Abuse of limits. Creating or using multiple accounts to work around usage limits, quotas, or a Subscription tier's allowances is a breach of these Terms (see Section 5).
You agree not to, and not to help or permit anyone else to:
5.1 break the law, or use Mana Grove for a fraudulent, deceptive, or illegal purpose;
5.2 harass, threaten, bully, or incite violence or hatred against another person or group;
5.3 upload, post, or generate content that is sexually exploitative of a minor, non-consensual, or otherwise unlawful;
5.4 impersonate another person or entity, or misrepresent your affiliation with a person or entity;
5.5 send spam or phishing attempts, or distribute malware, through Mana Grove;
5.6 attempt to gain unauthorized access to any account, system, or data, or attack, overload, or otherwise interfere with our infrastructure or other users' use of the Platform;
5.7 circumvent a geographic restriction, usage limit, quota, metering, or paywall, including by creating multiple accounts to obtain free-tier allowances you are not entitled to;
5.8 scrape, crawl, harvest, or use automated means to extract data from the Platform, except as we expressly permit;
5.9 reverse-engineer, decompile, or disassemble the Platform, our models, or our algorithms, except to the extent applicable law gives you a right to do so that cannot be contractually excluded;
5.10 resell, sublicense, or commercially redistribute access to the Platform, or use scraped or unauthorized access to our data to build a competing service;
5.11 attempt to manipulate rankings, recommendations, likes, follower counts, or other platform signals;
5.12 use Grover or another AI feature to try to extract our system prompts, models, or training data, to generate unlawful or harmful content, or to circumvent usage quotas;
5.13 infringe another person's intellectual property rights;
5.14 dox another user, or otherwise violate another person's privacy; or
5.15 use the Platform for a prohibited commercial purpose not otherwise permitted by these Terms.
We may remove content, restrict features (including access to Grover), or take the actions described in Section 16 if you breach this Section.
6.1 The Platform may change. We may modify, add to, or remove features, including Grover's functions and the feature sets included in each Subscription tier. We may also discontinue the Platform altogether. If we make a material adverse change to a paid feature, we will give you notice and, where required, the remedy described in Section 8.
6.2 No uptime guarantee. The Platform is provided on an "as is" and "as available" basis. We do not guarantee that it will be uninterrupted, secure, or error-free. Maintenance, updates, and outages, including outages of the third-party services we rely on, may affect availability, including for Grover and other AI features.
6.3 Future features. We may introduce new features in the future, including a marketplace, a card scanner, direct messaging, social badges, or a public API. Any such feature may be governed by additional terms that we will present to you before you use it.
6.4 Exception. This Section does not override Section 11 (Permanent Commitments), which can only be changed as described there.
7.1 Tiers. Mana Grove offers a free tier and four paid tiers (each, a "Subscription"). Prices are shown in the currency of your billing country: Canadian dollars for Canada, euros or pounds sterling, inclusive of VAT, for the European Union and the United Kingdom, and US dollars, exclusive of sales tax, for the United States, as set out below. Paid Subscriptions are offered to billing addresses in the countries listed at checkout; we add countries as we open them.
Canada. For a Subscription billed to an address in Canada, prices are in Canadian dollars and shown exclusive of tax; applicable taxes are added at checkout.
| Tier | Monthly (CAD) | Annual (CAD) | Grover messages per month |
|---|---|---|---|

| Pro | $14.99 | $149.90 | 1,500 |
| Unlimited | $29.99 | $299.90 | Unlimited, subject to fair use (Section 7.6) |
European Union. For a Subscription billed to an address in the European Union, prices are in euros and shown inclusive of VAT; that VAT is calculated, collected, and remitted by the merchant of record described in Section 7.8, not billed separately at checkout.

|---|---|---|---|
| Free | €0 | not applicable | 20 |

| Tier | Monthly (GBP) | Annual (GBP) | Grover messages per month |
|---|---|---|---|
| Free | £0 | not applicable | 20 |
| Starter | £2.99 | £29.90 | 100 |

| Unlimited | £21.99 | £219.90 | Unlimited, subject to fair use (Section 7.6) |
United States. For a Subscription billed to an address in the United States, prices are in US dollars and shown exclusive of tax; applicable US sales tax is added at checkout and is calculated, collected, and remitted by the merchant of record described in Section 7.8.
| Tier | Monthly (USD) | Annual (USD) | Grover messages per month |
|---|---|---|---|
| Free | $0 | not applicable | 20 |
| Starter | $3.99 | $39.90 | 100 |

| Unlimited | $29.99 | $299.90 | Unlimited, subject to fair use (Section 7.6) |
Annual plans bill once a year at the price shown, equivalent to twelve monthly payments for the price of ten.
For a Subscription billed to an address in any other country, prices are in Canadian dollars and shown exclusive of tax; applicable taxes are added at checkout.
7.2 No free trial. The Free tier is not a trial and does not expire. It is a genuine, ongoing, limited-feature way to use Mana Grove. The only exception is a free trial or free month that comes with a creator, store or event code we issue: it is open only to an account that has never had a Subscription or a free period, it requires a payment method at checkout, your Subscription is billed automatically when the free period ends unless you cancel before then, and each event code can be used only once.
7.3 No one-time purchases. Every paid feature is part of a Subscription. We do not sell credits, boosts, or other à la carte features.
7.4 Promotional codes and offers. We may provide promotional or discount codes and offers from time to time. They are subject to their own terms, may not be combined unless we say so, have no cash value, and we may withdraw them at any time.
7.5 Auto-renewal. Every paid Subscription renews automatically. A monthly plan renews every month and an annual plan renews every year, and it keeps renewing until you cancel it, until a renewal payment fails and the retry period in Section 8.7 runs out, or until your Subscription ends under Section 16. At each renewal, your payment method is charged the then-current price of your plan for the month or year ahead. That is the price for your tier, billing period and country in Section 7.1 as it stood when you subscribed, plus tax where Section 7.1 says prices are shown before tax, unless we have changed the price after giving you the notice described in Section 8.6. If a promotional code or an offer lowered your price for a limited time, renewals after that time are charged the regular price. There is no minimum commitment beyond the period you have already paid for.
How to cancel. You can cancel at any time, online and without contacting us: open the Plan & billing page of your account settings and choose Cancel plan. If your Subscription was purchased through Link (Section 7.8), you can also cancel it on Link's website, link.com. Cancelling stops every future renewal, and you keep your paid tier until the end of the period you have already paid for (Section 8.1). If anything stops you from cancelling online, write to support@themanagrove.com and we will help.
Payment processing. We use Stripe to process payments. We do not store your full card details; Stripe's own terms and privacy policy apply to how Stripe handles your payment information.
7.6 Fair use on the Unlimited tier. "Unlimited" means unlimited for ordinary personal use. It is not a licence to automate queries, resell access, or generate load that is plainly not a person building decks. If your use is a genuine outlier, we will contact you and work with you before taking any action.
7.7 Grover message allowances. Your Grover message allowance resets each month according to your billing cycle, and your remaining allowance is visible in the product. On the Free tier, you may send a small number of messages beyond your monthly allowance as a grace buffer, up to 23 messages in total; past that point, you cannot send further messages to Grover until your allowance resets or you upgrade.
7.8 Merchant of record for European Union, European Economic Area, United Kingdom, and United States purchases. For a Subscription billed to an address in the European Union, the European Economic Area, the United Kingdom, or the United States, Sold through Link, LLC, an affiliate of Stripe, Inc. ("Link"), acts as the merchant of record for that purchase under Stripe's Managed Payments service. This means that for that specific transaction, Link, not Mana Grove, is the party you pay, the party that issues your receipt or invoice, and the party responsible for calculating, collecting, and remitting the applicable VAT or other sales tax. Link acts as our undisclosed agent for this purpose: you interact with Link's own checkout, receipts, and order management tools (link.com), and your card statement will show a descriptor beginning with "LINK.COM*". Mana Grove remains the party responsible for the Platform itself, for your account, and for the subscription service you receive; this clause changes who processes and is accountable for the payment transaction, not who provides Mana Grove's service to you.
Link may refund such a purchase within 60 days of the original transaction in certain cases, and Stripe's support, through Link, may contact us about your request and, if we do not respond within 48 hours, may issue that refund without our further input. Where this applies, it takes the place of Section 8.2 and 8.3 for that purchase rather than operating alongside them; Section 8.5 (statutory rights) is unaffected. You may still contact us directly at support@themanagrove.com about a purchase handled this way, and we will assist even though Link, not Mana Grove, processes the refund itself.
8.1 Cancelling. You may cancel your Subscription at any time from your account settings. Cancellation stops future renewal; you keep access to your paid tier until the end of the period you already paid for, and your account then moves to the Free tier. We do not delete your decks, collection, or other content when you move to the Free tier; Free-tier limits simply apply going forward.
8.2 Monthly plans. Monthly Subscription fees are generally non-refundable for the current billing period. Cancelling stops the next charge.
8.3 Annual plans. If you cancel an annual Subscription within 14 days of purchase, we will refund you a prorated amount. After 14 days, annual Subscriptions are non-refundable, but your access continues to the end of the paid year. For a Subscription billed to the European Union, the European Economic Area, the United Kingdom, or the United States, see Section 7.8: Link's own 60-day refund process applies to that purchase in place of this Section 8.2/8.3.
8.4 Other refunds. We may issue a refund at our discretion for a duplicate charge, a billing error, or a verified failure of the service. Contact support@themanagrove.com.
8.5 Statutory rights. Nothing in this Section takes away a right that applicable law gives you, including any statutory right of withdrawal or cooling-off period that applies in your jurisdiction. Where such a right applies and is broader than Section 8.3, the broader right governs.
8.6 Price changes. We may change Subscription prices. If you are an existing subscriber, we will give you at least 30 days' notice before a price change applies to your plan, and you may cancel before it takes effect.
8.7 Failed payments. If a payment fails, we will keep you on your current tier for a 3-day retry period before moving your account to the Free tier. Your content is not deleted; you simply return to Free-tier limits until you resolve the payment and, if you wish, resubscribe. A failed first payment at checkout simply means the Subscription does not start; the retry period applies to renewals of an active Subscription.
8.8 Renewal reminders. If you are on an annual plan, we will email you a reminder at least 30 days before your renewal date.
8.9 App store purchases. A purchase made through the Apple App Store or Google Play is billed by that store and refunded under that store's rules, and any refund request for it goes to the store.
9.1 What Grover is. Grover is our AI-powered deck assistant. It helps you build and refine decks, search for cards using natural language ("Scry"), get recommendations, and identify card combinations. Grover and other algorithmic features, such as search ranking and recommendations, are automated systems, not humans, and we label them as AI-enabled features.
9.2 Grover can be wrong. Grover's outputs may be inaccurate, incomplete, or out of date. Grover is informational only and is not professional, financial, or legal advice. Official rules and the current rules and tournament policies of the trading card game you are playing always prevail over anything Grover tells you. We do not guarantee the accuracy of card prices, tournament-legality determinations, deck-performance predictions, or competitive outcomes that Grover, or any other feature of the Platform, provides. Verify anything important independently, and do not rely solely on Grover for a decision that matters to you.
9.3 How we use your information with Grover. What we do with your prompts and conversations with Grover, including how long we keep them, is described in the Privacy Policy. In short: we do not use your personal information to train or improve our AI models unless you separately opt in. If we offer an AI-improvement program in the future, it will be off by default and will require your separate, express consent, as described in the Privacy Policy.
9.4 Quotas. Your use of Grover is subject to the message allowances for your Subscription tier described in Section 7. Attempting to circumvent those allowances is a breach of Section 5.
9.5 Human review. At launch, no decision that materially and adversely affects your account, access, or eligibility is made solely by an automated system. A human reviews a meaningfully adverse action before it takes effect, consistent with the Privacy Policy.
9.6 Scry on Discord. Scry on Discord, the Mana Grove app in Discord, brings Scry, our natural-language card search (Section 9.1), to Discord servers. In a Discord server where it has been added, the /scry command posts the closest matching cards, and the /scryimage command posts the top match with its card image, in the channel where you typed the command, with links to those cards on the Platform. The /bracket command reads the text of a decklist you submit to check that list's Commander bracket; we use that text only to answer the command. When the link in a private /bracket reply is opened, its address, which contains the list, is kept in our routine server logs for up to 30 days; beyond those logs, we keep nothing of the list (Privacy Policy, Sections 4.11 and 4.12). The /help command shows you, and only you, what each command does, with an example. If you use one of these commands, you agree to these Terms as they apply to Scry on Discord: read them as if Scry on Discord were part of the Platform, except for the Sections that concern a Mana Grove account or a Subscription. Scry on Discord does not need or create a Mana Grove account, and it does not use any account's allowances.
Discord's own terms. Scry on Discord works inside Discord, a service run by a separate company that does not make, endorse or sponsor Scry on Discord. Your use of Discord, including the server where you use a command, is governed by your own agreement with Discord, and we operate Scry on Discord under Discord's Developer Terms of Service and Developer Policy. Discord is not a party to these Terms.
Minimum age. You may use Scry on Discord only if you meet the minimum age in Section 3.1 for where you live, the same age that applies to creating an account.
Where it is offered. Scry on Discord is intended for players in the countries listed in Section 2.4. Discord does not tell us where you are, so we apply these Terms, and the handling described in the Privacy Policy, to every command in the same way.
Acceptable use. Section 5 applies to how you use Scry on Discord. In particular, do not send commands with scripts, other bots or other automated means, do not send them in bulk, and do not try to get around its limits, for example by using several Discord accounts or servers.
Limits and availability. Scry on Discord limits how many searches one person, one server, and all servers together can run in a given minute, hour or day; the daily limits reset at midnight UTC. When a limit is reached, when Scry on Discord is busy, or when we have paused it, it refuses the command, and only you see that refusal. We may change these limits, pause Scry on Discord or withdraw it at any time, without notice. Section 6 applies to it, including Section 6.2: there is no uptime guarantee.
Public replies. The reply to a command is posted in the channel where you used it, and anyone who can see that channel can read it. It does not print the words you searched for, but its links to our search page carry them, so anyone who opens or copies one of those links can see them. Do not search for anything you would not post in that channel yourself. Refusals, such as a limit notice, are shown only to you.
Results. Scry on Discord shows results drawn from the same Scry search as the Platform, ranked by relevance only and never sponsored, and it shows no advertising (Section 11). They are informational only, are not advice, and can be wrong or incomplete (Section 9.2). Card data, card images and trademarks in a reply are covered by Section 13.
Liability. Section 17 applies to Scry on Discord. Discord is a third-party service under Section 17.4: we are not responsible for Discord, for how a server is run, or for what other people post in it.
Questions. Write to support@themanagrove.com. The Privacy Policy explains what Scry on Discord receives and keeps (Privacy Policy, Section 4.11).
10.1 You own your content. You own your decks, collections, deck names, descriptions, notes, comments, avatar, biography, and other content you create or upload to the Platform ("your content"). We claim no ownership over it.
10.2 The licence you give us. You grant us a limited, non-exclusive licence to host, store, reproduce, display, process, and distribute your content, solely to operate, provide, secure, and improve the Platform for you, including showing your public content to other users at your direction. This licence ends when you delete the content or your account, subject to the backup and legal-retention windows described in the Privacy Policy.
10.3 Public sharing. Decks and collections are private by default. If you choose to make a deck or collection public, you give other users permission to view and copy it within the Platform. You can make content private again at any time, though copies other users already made may remain in their accounts.
10.4 Promotional use. We may feature or display your public content within the Platform, for example in search, discovery, or recommendation surfaces. We will not use your public content in off-platform marketing, such as a newsletter, advertisement, or our social media accounts, without obtaining your separate permission.
These are not marketing copy. We are putting them in our Terms so they are binding, not aspirational.
11.1 We will never run display advertising on the Platform.
11.2 We will never sell your personal data, to anyone, for any price.
11.3 Advertising stays in your hands. We show no advertising on the Platform. Off the Platform we may advertise Mana Grove to people who have allowed advertising cookies; you can withdraw that permission at any time in your privacy settings, and nothing we do for advertising ever gives anyone else access to your account data.
11.4 We will never insert affiliate links to third-party retailers. If we show you a price, it is because it is useful to you, not because someone paid us for the click.
11.5 We will never paywall the basics: format-legality checking and deck mana statistics are free, unlimited, and always will be. Deck saving is always available on the Free tier; the number of decks you can save on each tier, and other allowances, are published on our pricing page.
11.6 How these can change. Sections 11.1 through 11.5 can be amended only by unanimous vote of our founders, meaning the individuals recorded as founders in Mana Grove's corporate records at the time of the proposed amendment (if no recorded founders remain, approval falls to the board of directors of The Mana Grove Trading Cards Ltd.), and with at least 90 days' advance written notice to users, never by a routine Terms update.
11.7 Measuring an advertisement is not following you. Measuring whether an advertisement worked is not the same as following you around the internet. Every conversion we send to an advertising platform from our servers carries ad personalization denied, so it may be counted and may not be used to target you, and we never send one unless you have agreed to advertising measurement or, in Canada outside Quebec and in the United States, unless you have told us to stop, in which case we stop. If you live in California, or we cannot tell which US state you are in, we ask you first instead, and anywhere in the United States we treat a Global Privacy Control signal from your browser as telling us to stop. Advertising audiences are a separate thing, governed by Section 11.3: they exist only for people whose Advertising cookie category is on, and never for anyone else. We never sell your personal information.
12.1 Mana Grove and its licensors own the Platform, including our software, interfaces, designs, branding, logos, databases, recommendation systems, Grover and its underlying models, algorithms, documentation, and original content, along with our trade secrets and our rights in how we organize and compile data.
12.2 We grant you a limited, revocable, non-exclusive, non-transferable licence to access and use the Platform in accordance with these Terms. This licence does not give you any ownership interest in the Platform.
13.1 Card data. Card metadata displayed on the Platform, such as card names, mana costs, and format legality, is sourced from a third-party data aggregator and is provided for informational purposes only. We do not guarantee its accuracy, completeness, or timeliness.
13.2 Card images. Card images displayed on the Platform are self-hosted and were originally sourced from third-party providers. Wherever a card itself is shown, the full card image is displayed unaltered, with artist and copyright lines intact. Some interface surfaces, such as deck thumbnails and banners, use an artwork-only excerpt exactly as provided by our image source; the full card with its credits is always available from the card's detail view. We never alter images or remove credits ourselves. Trademarks, copyrights, and other intellectual property in card names, card text, card art, and related marks belong to their respective owners, not to us.
13.3 Pricing information. Pricing information shown on the Platform is aggregated from third-party sources, is provided for informational purposes only, and may be inaccurate, delayed, or unavailable. Nothing on the Platform is financial advice, and you should not buy, sell, or value anything on the strength of pricing information shown to you.
13.4 Trademark notice and non-affiliation. Magic: The Gathering, all related card names, card text, card art, mana symbols, set logos, and trade dress are the intellectual property of Wizards of the Coast LLC, protected by trademark and/or copyright as applicable. Mana Grove is not affiliated with, endorsed by, sponsored by, or approved by Wizards of the Coast LLC or Hasbro, Inc. Mana Grove is an independent set of tools built for players of trading card games, and we do not claim any official status.
13.5 Copyright and trademark complaints. If you believe content on the Platform infringes your copyright or trademark, send a notice to support@themanagrove.com that identifies the work or mark you claim is infringed, the material you claim is infringing and where it appears on the Platform, and your contact information. We handle copyright complaints under the Canadian notice-and-notice framework: when we receive a valid notice, we forward it to the user who posted the content and keep a record that we did so, as Canadian law requires. Trademark complaints fall outside that framework, so we review them separately when we receive them and respond to the complainant directly. For both kinds of complaint, we may remove or restrict access to content after review of a complaint. A user who receives repeated valid infringement notices is subject to the enforcement actions described in Section 16, up to and including account termination.
14.1 Our Privacy Policy explains what personal information we collect, how we use it, and the rights and choices available to you. Our Cookie Policy explains how we use cookies and similar technologies on your device. Both are separate documents, referenced here, that govern personal information and device storage respectively; accepting these Terms is separate from any consent you give under those policies.
14.2 How we handle information related to Grover and other AI features, including retention and any future AI-training program, is described in the Privacy Policy (see Section 9.3).
15.1 By using Mana Grove, you consent to receive service, security, transactional, and legal notices from us electronically, by email to the address on your account and/or in-app, instead of by mail.
15.2 Marketing communications are separate: we will only send them with your consent as required by applicable law, and you can unsubscribe at any time. Withdrawing marketing consent does not affect the service, security, transactional, or legal notices described in Section 15.1.
16.1 What we may do. If you breach these Terms, including the Acceptable Use rules in Section 5, or if we reasonably believe you pose a risk to the Platform, other users, or us, for example through fraud, a security threat, illegal conduct, payment abuse or chargebacks, intellectual property infringement, or manipulation of platform signals, we may remove or restrict your content, issue a warning, disable a feature, restrict your access to Grover or another AI feature, suspend your account, or terminate your account.
16.2 If we terminate your account for cause. Your paid access ends. We do not owe you a refund except where required by law or under Section 8. Your public content is removed or de-linked from your identity as described in the Privacy Policy. Where feasible, you may use the self-service export tool described in Section 16.5 before deletion completes.
16.3 If we discontinue the Platform. We may stop offering the Platform with reasonable notice to you.
16.4 Termination by you. You may stop using Mana Grove at any time. To end a paid Subscription, see Section 8.1. To delete your account entirely, use the self-service tool described in Section 16.5. Ending your account does not relieve you of amounts you already owe us.
16.5 Data export and account deletion. You can request a copy of your data or delete your account from your account settings. Account deletion requires you to confirm the request, after which a 30-day grace period begins during which you can cancel. Details, including what is retained and for how long, are in the Privacy Policy.
16.6 Appeals. If you believe we took an enforcement action against you in error, contact support@themanagrove.com. A person reviews appeals and will respond within a reasonable period.
17.1 As-is. To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted or error-free, or that card data, card images, or pricing information will be accurate (see Section 13).
17.2 Limitation of liability. To the fullest extent permitted by law, our total aggregate liability to you for any claim arising out of or relating to Mana Grove is limited to the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) CAD $100. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or lost opportunities, even if we were told they were possible.
17.3 What we do not limit. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, our gross negligence or wilful misconduct, or anything else that cannot lawfully be excluded or limited.
17.4 Third-party services. The Platform relies on third-party services, such as our payment processor and hosting providers, to operate. Links to independent third-party websites, and independent third-party services you choose to use, are governed by those third parties' own terms and policies, and we are not responsible for them. This Section does not limit our responsibility for our own contractual, consumer, and privacy obligations, including in respect of the service providers we use to operate the Platform.
17.5 Your statutory rights. If you are a consumer, you have statutory rights that these Terms cannot take away. Where this Section conflicts with a non-excludable right you have under applicable consumer-protection legislation, that right governs and this Section gives way to the extent of the conflict.
18.1 If you use Mana Grove for a business purpose, rather than as a consumer, you agree to indemnify us against claims arising from your breach of these Terms, your content, or your unlawful use of the Platform.
18.2 This Section does not apply if you are using Mana Grove as a consumer. We are not asking ordinary players to indemnify us.
19.1 Governing law. These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply in it.
19.2 Courts. The courts of Ontario have jurisdiction over any dispute arising from these Terms, subject to Section 19.3.
19.3 Consumers keep their home protections. If mandatory consumer-protection law in your place of residence gives you a right to bring proceedings in your local courts, or otherwise protects you regardless of the choice of law in Section 19.1, this Section does not take that right away.
19.4 No arbitration, no class-action waiver. These Terms do not include a mandatory arbitration clause or a class-action waiver. If you have a dispute with us, you may pursue it through the courts described above.
19.5 Talk to us first. Before starting a formal proceeding, please contact us at support@themanagrove.com. Most issues can be resolved this way, and we will review your message and respond substantively within 30 days. Contacting us first is not a mandatory precondition to bringing a claim. Nothing in this Section delays or limits immediate action on urgent fraud, abuse, or security threats.
20.1 We may update these Terms. If a change is material, we will give you advance notice by email and/or in-app before it takes effect, and ask you to re-accept where required by law. Non-material changes take effect when we post them and update the date at the top of this document.
20.2 If you continue using Mana Grove after a change takes effect, where permitted by law, that means you accept it. If you do not accept a material change, you may cancel your Subscription before it takes effect.
20.3 Changes to the Permanent Commitments in Section 11 require unanimous founder approval and 90 days' notice, as described there.
21.1 Severability. If a provision of these Terms is unenforceable, the rest survive, and the unenforceable provision is narrowed to the minimum extent necessary.
21.2 No waiver. If we do not enforce a right under these Terms, we have not waived it.
21.3 Assignment. You may not assign these Terms. We may assign them to a successor in connection with a merger, acquisition, or sale of assets, on notice to you.
21.4 Entire agreement. These Terms are the entire agreement between you and us about Mana Grove. The Privacy Policy and Cookie Policy are separate documents, as described in Section 14.
21.5 Survival. Provisions that by their nature should survive the end of your account, including Sections 12, 13, 17, 18, and 19, continue to apply after your account ends.
21.6 Force majeure. We are not liable for a failure to perform caused by events outside our reasonable control.
21.7 Language. These Terms are published in English and French. Both versions are intended to convey the same information; questions of interpretation are subject to applicable law.
